Abstract:

By means of investigating the international pattern of access, exploitation and benefit sharing of genetic resources under economic and technological globalization background, the necessity and urgency of forming a mechanism of rational access and fair benefit sharing of genetic resources were recognized. The national sovereignty principle and property rights of genetic resources with international recognition were construed and institutional arrangements for establishing and coordinating the mechanism of genetic resources access and benefit sharing were also analyzed.

通过考察经济技术全球化背景下遗传资源的获取、利用及其利益分享的国际格局,认识到建立遗传资源合理获取和公平惠益分享机制的必要性和迫切性;并对国际认同的遗传资源国家主权及产权原则,以及建立、协调遗传资源获取和惠益分享机制的制度安排进行了分析。
